If you’ve been charged with a driving conviction, you’ll want to learn from the past and move forwards towards the future. But for now, you’ll have to work with points on your licence. So, how long do they last? And how long do you have to declare them to insurance companies? We’ve summarised each conviction below.

How long do you have to declare points for insurance?

Under the Road Traffic Act 1998, it is an offence to withhold relevant information when applying for car insurance, so you’re legally obliged to declare penalty points to your insurer. Points are considered ‘spent’ after five years has passed, so an insurer is legally not allowed to increase your premium after this.

Essentially, if an insurance company asks and your points are still on your licence (but your conviction is spent) it is commonly accepted that you should declare it. However, as the financial ombudsman states, if an insurance company cancels your policy after finding out, they will uphold a complaint against the company.

You can read more about what to do when your points expire.

“if a firm cancels the policy of a customer who has a spent conviction (but whose licence is still endorsed), simply because the customer did not disclose the endorsement, then we will uphold the customer’s complaint.”
