How long do you have to declare points for insurance?

Under the Rehabilitation of Offenders Act, legally, insurers are not allowed to increase your premium if your driving conviction has been spent. ‘Spent’ refers to the points no longer being on your driving licence, or 5 years having passed. Even if you have an 11 year endorsement, it will be considered spent after 5 years. Insurers can ask, but they cannot use that information as a reason to increase your premium.

The financial ombudsman states:

“if a firm cancels the policy of a customer who has a spent conviction (but whose licence is still endorsed), simply because the customer did not disclose the endorsement, then we will uphold the customer’s complaint.”

Essentially, if an insurance company asks and your points are still on your licence (but your conviction is spent) it is commonly accepted that you should declare it. However, as the financial ombudsman states, if an insurance company cancels your policy after finding out, they will uphold a complaint against the company.
However, this becomes a very grey area. As under the Road Traffic Act 1998, it is an offence to withhold relevant information when applying for car insurance. This means that you’re legally obliged to tell a prospective (or current) insurer of any penalty points you receive.
